Terms & Conditions

1. Our Service

WHY NOT is a private, luxury mobile bar and bartending service operating in Miami and South Florida. We provide bartenders, mobile bar setup, glassware, ice, mixers, bar tools and related bar equipment for private events.

2. Liquor Policy

  • We do not sell, supply, or distribute alcohol as a licensed vendor.
  • All liquor is purchased, owned and legally controlled by the host or venue.
  • At the host’s request, we may assist with planning, counting and recommending bottle quantities.
  • If you would like us to physically purchase alcohol on your behalf, we can do so strictly as a convenience service using your funds. In this case:
    • The alcohol remains your property at all times.
    • We charge a $100 shopping & delivery coordination fee for this service.
    • We do not mark up the price of alcohol; receipts can be provided upon request.

3. Age & Legal Compliance

  • The host is responsible for ensuring that all guests consuming alcohol are 21 years of age or older.
  • Our bartenders reserve the right to request ID and refuse service to any guest who appears underage, intoxicated, or aggressive.
  • We comply with applicable local and state regulations related to alcohol service to the best of our knowledge and ability.

4. Responsibility & Liability Waiver

By booking WHY NOT, you acknowledge and agree that:

  • You, as the host or booking party, are solely responsible for the behavior, safety and actions of all guests at your event.
  • WHY NOT and its staff are not responsible or liable for:
    • Injury to guests or third parties,
    • Damage to property, vehicles or venues,
    • Any incident, accident, altercation or legal issue arising from alcohol consumption or misuse.
  • You agree to take reasonable measures to promote responsible drinking, including arranging safe transportation (rideshare, designated drivers, etc.) for guests who have been drinking.

By confirming your booking, you agree to hold WHY NOT, its owners, staff and contractors harmless from any claims, damages, or expenses arising from your event, except in cases of proven gross negligence on our part.

5. Booking, Payment & Cancellation

  • A deposit (typically 30% unless otherwise stated in writing) may be required to secure your date.
  • Remaining balance is generally due no later than 24 hours before the event start time, unless otherwise agreed in writing.
  • Deposits are typically non-refundable for cancellations made within 14 days of the event date, as that time is held exclusively for your event.
  • Rescheduling is subject to availability and may be treated as a new booking.

6. Event Duration & Overtime

Standard service is structured in hourly blocks (for example, 3–4 hours of active bar service plus setup and breakdown). If the event runs longer than agreed:

  • Overtime is subject to staff availability.
  • Additional time may be billed (for example) at $100 per hour per bartender, or as agreed in your proposal.

7. Setup, Equipment & Damages

  • We require a safe, reasonable area for bar setup, with access to power (if needed), lighting and safe walking paths.
  • You are responsible for ensuring the space is safe for staff and guests (no exposed hazards, unsafe wiring, etc.).
  • The host is responsible for any damage to our equipment, glassware, or bar setup caused by guests or third parties.

8. Weather & Outdoor Events

For outdoor setups, you are responsible for providing appropriate cover (tent, canopy, etc.) in case of rain or extreme sun. If weather conditions make it unsafe to operate, we may need to pause or relocate the bar.

9. Photos, Video & Promotion

We may capture photos/video of the bar setup, glassware, or general ambience for promotional use. We will avoid clearly identifying guests unless we receive explicit consent.
